Terms & Conditions

These General Terms & Conditions apply to every offer made by BesCards B.V. and to every distance contract and order concluded between us and the customer. Please read them carefully. By placing an order you accept these terms.

B2B Terms

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
  • Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the trader;
  • Business customer (B2B): any customer acting in the course of a profession or business; an order is treated as B2B when a company name and/or VAT number is provided at checkout or on the invoice;
  • Day: calendar day, unless "working day" is stated;
  • Sealed product: any product supplied in factory or manufacturer shrink-wrap or seal (including booster packs, booster boxes, bundles, tins, ETBs and similar sealed trading-card products);
  • Durable medium: any means enabling the consumer or trader to store information addressed to them personally in a way that allows future consultation and unaltered reproduction;
  • Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;
  • Model form: the model withdrawal form the trader makes available for a consumer to complete when exercising their right of withdrawal;
  • "BesCards", "we", "us", "the trader": the private limited company BesCards B.V., trading under the name BesCards;
  • Distance contract: a contract concluded through the trader's online system without the trader and customer being physically together;
  • Terms & Conditions: the present General Terms & Conditions of the trader.

Article 3 – Applicability

These terms apply to every offer by the trader and to every distance contract and order between the trader and the customer. Before the distance contract is concluded, the text of these terms is made available to the customer in a way that can easily be stored on a durable medium. If this is not reasonably possible, we will indicate where the terms can be consulted electronically and send them free of charge on request.

Where specific product conditions apply in addition to these terms, and in the event of conflict, the consumer may always rely on the provision most favourable to them.

If any provision is wholly or partly void or annulled, the contract and remaining provisions remain in force, and the provision concerned will be replaced by one that approximates the original as closely as possible. Situations not covered by these terms are assessed in the spirit of these terms.

Article 4 – The offer

If an offer has a limited period of validity or is subject to conditions, this is stated explicitly. The offer is without obligation and we are entitled to change or adjust it.

The offer contains a complete and accurate description of the products, detailed enough to allow a proper assessment. Images are a truthful representation but we cannot guarantee that displayed colours exactly match the real product. Obvious mistakes or errors in the offer, including pricing errors, do not bind the trader.

Each offer makes clear what rights and obligations are attached to acceptance, in particular the price including VAT, any shipping costs, the method of payment and delivery, and whether the right of withdrawal applies.

Article 5 – The contract

The contract is concluded when the consumer accepts the offer and meets the associated conditions. After an electronic order we confirm receipt electronically without delay. Until receipt has been confirmed, the consumer may dissolve the contract.

We take appropriate technical and organisational measures to secure electronic data transfer and payment. Within legal frameworks we may inform ourselves whether the customer can meet their payment obligations; on reasonable grounds we may refuse an order or attach conditions to it, stating reasons.

Every contract is entered into subject to sufficient availability of the products. Where availability is limited, allocation may apply.

Article 6 – Right of withdrawal (consumers)

When purchasing products, the consumer may dissolve the contract without giving reasons for 14 days. This cooling-off period starts on the day after the consumer, or a representative designated in advance, receives the product.

During the cooling-off period the consumer handles the product and its packaging with care and only unpacks or uses it to the extent necessary to assess whether they wish to keep it. Please note the important exception for sealed products in Article 7.

To exercise the right of withdrawal, the consumer notifies us within 14 days of receipt, by email to support@bescards.com or via the model withdrawal form. The consumer then returns the product within 14 days of that notification and can prove timely return, for example by proof of shipment. If the consumer has not notified us in time or not returned the product in time, the purchase is final.

This right of withdrawal applies to consumers only. Business (B2B) customers do not have a right of withdrawal (see B2B Terms).

Article 7 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to the products listed below, provided this is clearly stated in the offer or in good time before the contract is concluded:

  • Sealed products whose seal has been broken. For reasons of authenticity and value protection, sealed trading-card products (booster packs, booster boxes, bundles, tins, ETBs and similar) cannot be returned once the seal or shrink-wrap has been broken. As long as the product remains sealed and unopened, the standard 14-day right of withdrawal applies;
  • products made to the consumer's specifications or clearly personal in nature;
  • products that by their nature cannot be returned or can deteriorate or expire quickly;
  • products whose price is tied to fluctuations in the financial market beyond our control;
  • individual newspapers and magazines;
  • audio/video recordings and software whose seal has been broken.

Article 8 – Costs & refunds on withdrawal

Return costs: The direct cost and risk of returning the products are borne by the consumer, unless the return results from our error (e.g. a wrong or defective item). We recommend returning with track & trace, as the risk of the return shipment lies with the consumer until we receive it.

Refunds: If the consumer withdraws in time, we refund the payments made — including the standard (cheapest) delivery cost of the original order — without delay and no later than 14 days after being notified. We may withhold the refund until the product has been received back and its condition checked. Refunds are made using the same payment method the consumer used, unless otherwise agreed.

If the consumer chose a more expensive delivery method than the cheapest standard option, the surplus is not refunded. If a product's value is reduced through handling beyond what was necessary to assess it, the consumer is liable for that reduction — this does not apply if we failed to provide the legally required information about the right of withdrawal.

Article 9 – The price

During the validity period stated in the offer, prices will not be increased, except for changes resulting from VAT rates. All prices include VAT and are subject to obvious printing or typesetting errors, for the consequences of which no liability is accepted; we are not obliged to deliver at an incorrect price.

For products whose price is tied to financial-market fluctuations beyond our control, prices may be variable and any stated price is a target price; this is stated in the offer. See Article 14 for pre-order pricing.

Article 10 – Conformity & warranty

We guarantee that products comply with the contract, the specifications in the offer, reasonable requirements of soundness and usability, and the legal provisions existing when the contract was concluded. Any commercial or manufacturer warranty does not affect the consumer's statutory rights.

The warranty does not apply if:

  • the consumer has repaired or modified the products themselves or via third parties;
  • the products have been exposed to abnormal conditions or handled carelessly or contrary to our instructions;
  • the defect results wholly or partly from government regulations on the nature or quality of materials used.

Article 11 – Delivery & performance

We exercise the greatest possible care when handling orders. The place of delivery is the address the customer provided. Providing a correct and complete delivery address is the customer's responsibility; we are not liable for non-delivery caused by an incorrect or incomplete address.

Accepted orders are executed with due speed and no later than 30 days, unless a longer period is agreed (see Article 14 for pre-orders). If delivery is delayed or only partially possible, the consumer is notified within 30 days and may then dissolve the contract free of charge, without a right to compensation. Stated delivery periods are indicative.

Shipping & proof of delivery: All orders are shipped with track & trace, and higher-value orders with signature on delivery. The carrier's track & trace record — including the delivery scan and, where applicable, signature — serves as proof of delivery. The risk of damage and/or loss rests with the trader until the moment of delivery to the consumer or their designated representative.

Article 12 – Non-delivery & missing parcels

We want every parcel to arrive. If a parcel does not arrive, or if track & trace shows it as delivered but you believe you have not received it, please contact us at support@bescards.com as soon as possible, and in any event within 5 days of the (expected) delivery date.

This timeframe matters because our carrier can only open an investigation into a lost or misdelivered parcel within a limited period after delivery. When you report in time, we will start an investigation with the carrier and resolve the matter with you. If the report reaches us after this period, the carrier can no longer investigate, which significantly limits our ability to trace the parcel and reach a solution. Reporting promptly is therefore essential and in your own interest.

Where a signature or delivery scan confirms delivery to your address, this is treated as proof that the order was delivered.

Article 13 – Damaged or incorrect items

If your order arrives damaged, incomplete, or you received an incorrect item, please report it to support@bescards.com within 3 days of delivery, including clear photos of the product and packaging. Reporting within this period allows us to file a timely claim with the carrier or supplier and arrange a replacement, repair or refund. Please keep the original packaging until the matter is resolved.

Article 14 – Pre-orders & back-orders

For upcoming releases we may offer products for pre-order or back-order. Release dates and prices for these items are set by the manufacturer/distributor and are subject to change. Stated release dates are indicative, and a pre-order is fulfilled as soon as stock is received. Where availability is limited, allocation may apply and we will inform affected customers.

Consumers: Your statutory 14-day right of withdrawal applies to pre-orders as it does to other products (subject to the sealed-product exception in Article 7). The cooling-off period starts the day after you receive the item, not when you order it. Because pre-order stock is purchased and allocated based on confirmed orders, we ask you to order carefully.

Business customers (B2B): All B2B orders, pre-orders and back-orders are binding. No cancellations are possible. Please take care not to over-order.

Article 15 – Payment

Unless otherwise agreed, orders are paid at checkout. The customer must report any inaccuracies in payment details provided to us without delay. In case of non-payment, and subject to legal restrictions, we may charge reasonable collection costs made known in advance.

Article 16 – Complaints procedure

Complaints about the performance of the contract should be submitted, fully and clearly described, to support@bescards.com. We answer complaints within 14 days of receipt. If a complaint needs a foreseeably longer processing time, we confirm receipt within 14 days and indicate when you can expect a fuller answer. A justified complaint is resolved, at our choice, by free replacement, repair or refund.

Consumers in the EU may also submit disputes via the European ODR platform at ec.europa.eu/consumers/odr.

Article 17 – Disputes & applicable law

Contracts to which these terms apply are governed exclusively by Dutch law, even if the customer lives abroad. The Vienna Sales Convention (CISG) does not apply.

Article 18 – Additional or deviating provisions

Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing or stored by the consumer on a durable medium.

B2B Terms

The following applies to business customers. Consumer law, including the right of withdrawal, does not apply to B2B orders. An order is treated as B2B when a company name and/or VAT number is provided at checkout or on the invoice.

Returns, damage & non-delivery

We operate a no-return policy for B2B shipments. Any complaint about missing, damaged, incorrect or non-delivered goods must be reported to support@bescards.com within 3 working days of the (expected) delivery date, with photos where relevant. All orders are shipped with track & trace and, where applicable, signature on delivery, which serves as proof of delivery. Complaints reported after 3 working days cannot be processed, as our carrier can no longer investigate.

Pre-orders & back-orders

All B2B orders, pre-orders and back-orders are binding — no cancellations are possible, so please take care not to over-order. Release dates and prices are subject to change. In case of limited availability, allocation may apply to the respective pre-orders/back-orders.

Liability & product condition

All products are received shrink-wrapped from our suppliers. We are not liable for the sealed contents of manufacturer-sealed products. If a defective item is found within a delivered quantity, contact support@bescards.com within the period above so we can resolve it.

Force majeure

If, for reasons beyond our control (e.g. severe weather, strikes, supply disruption), delivery is not possible within a reasonable period, we will notify you by email and ask whether you still wish to complete the order under these conditions.

Retention of title & order confirmation

All delivered products remain the property of BesCards until payment has been received in full. Before shipping, our sales department may contact you to check and confirm the order.
